(TheRedAlertNews.com) – BREAKING NOW: In a decision that outraged Democrats, a judge in Delaware has ruled that the vote-by-mail law there is unconstitutional.
Further, the judge has ordered that his decision applies to the upcoming midterm elections that are less than two months away.
The question now is whether this is the start of a judicial trend that will sweep the nation.
As the team at Newsmax is now reporting in, “Delaware Judge: State’s Vote-by-Mail Law Unconstitutional“:
“A Delaware judge ruled Wednesday that a new vote-by-mail law enacted earlier this year is unconstitutional and that voting by mail cannot be used in the November election.
“Vice Chancellor Nathan Cook ruled that the law, the result of legislation that Democrats rammed through the General Assembly in less than three weeks this past June, violates a provision in Delaware’s constitution that spells out the circumstances under which a person is allowed to cast an absentee ballot.” [emphasis added]
Specifically, the judge wrote:
“Our Supreme Court and this court have consistently stated that those circumstances are exhaustive. Therefore, as a trial judge, I am compelled by precedent to conclude that the vote-by-mail statute’s attempt to expand absentee voting … must be rejected.” [emphasis added]
One voting law expert opined that Republicans will quickly look for other states with similar constitutional provisions and file challenges to vote-by-mail laws in those states if they haven’t done so already.
