District Attorney George Gascón’s controversial move to recommend resentencing for Erik and Lyle Menendez has reignited a debate that many assumed was long settled.

The brothers were originally convicted in 1989 for the murder of their parents, José and Kitty Menendez, and sentenced to life without parole.

Gascón’s recommendation suggests altering the life without parole sentence to 50 years to life, potentially making them eligible for parole immediately due to their ages at the time of the crime.

“I want to underline there were horrible acts, there is no excuse for murder … but I understand also how sometimes people get desperate,” he noted.

“There are people in the office that strongly believe that the Menendez brothers should stay in prison the rest of their life, and they do not believe that they were molested,” Gascón admitted.

“And there are people in the office that strongly believe that they should be released immediately and that they were in fact molested,” he added, cited by Today.com.

The timing of this decision aligns with a renewed public interest in the case, spurred by a Netflix series and documentary.

Furthermore, Gascón’s approach precedes his reelection bid, where his decisions are likely to influence public opinion.

“We’re going to recommend to the court that the life without the possibility of parole be removed and that they will be sentenced for murder, which, because there are two murders involved, that would be 50 years to life. However, because of their age under the law, since they were under 26 years of age at the time that these crimes occurred, they will be eligible for parole immediately,” Gascon declared, cited by Newsweek.
