(TheRedAlertNews.com) – In a crucial move meant to rectify a gross injustice, former President Donald Trump plans to initiate a $100 million lawsuit against the Justice Department, stemming from the FBI’s raid on his Mar-a-Lago estate two summers ago.
This action came before special counsel Jack Smith’s prosecution related to classified documents, National Review notes in a report.
Trump’s legal team has formally indicated their intention to sue, asserting that the raid was a form of political persecution and falls under “tortious conduct by the United States against President Trump,” as initially reported by Fox News.
The Justice Department now has a six-month period to respond to this notice and seek a resolution.
According to Trump’s attorney, Daniel Epstein, in the legal filing, the accusations of tortious actions include “intrusion upon seclusion, malicious prosecution, and abuse of process resulting from the August 8, 2022 raid.”
Epstein further claimed that this raid infringed upon Florida’s privacy laws, articulating that “The FBI’s demonstrated activity was inconsistent with protocols used in routine searches of an investigative target’s premises,” and stressed Trump’s “clear expectation of privacy at Mar-a-Lago.”
Epstein criticized the FBI’s actions during the raid as a “severe and unacceptable intrusion that is highly offensive to a reasonable person.”
In a significant judicial development, Trump-appointed Judge Aileen Cannon dismissed the case regarding the classified documents last month, deeming Smith’s appointment unconstitutional.
Despite this, the Justice Department is appealing her decision.
This follows a concurring opinion by Supreme Court Justice Clarence Thomas in a related matter, suggesting the unconstitutionality of Smith’s appointment under the appointments clause.
Furthermore, the Supreme Court ruled that Trump is entitled to presidential immunity for official acts, referring his January 6 case back to a lower court.
In Washington, DC, Smith is also prosecuting Trump for charges linked to his alleged involvement in the January 6 events at the US Capitol.
Trump faces 40 charges including the willful retention of national defense information, obstruction of justice, making false statements, and attempting to delete records, with 31 charges under the espionage act related to the possession of military secrets.
Trump has pleaded not guilty to all charges and has vocally denounced Smith’s actions as a politically motivated prosecution. It is improbable that Trump will face trial in any of Smith’s cases before the upcoming Election Day.
