The Justice Department has filed a lawsuit against four New Jersey cities: Newark, Jersey City, Hoboken, and Paterson.
These cities have been accused of violating federal law by not cooperating with U.S. Immigration and Customs Enforcement (ICE).
The Attorney General’s Office claims these sanctuary policies hinder enforcement of U.S. immigration laws and shield illegal immigrants from prosecution.
Mayors Ras Baraka, Steven Fulop, Andre Sayegh, and Ravi Bhalla, all Democrats, are named in the lawsuit.
Fulop and Baraka, who are running in the Democratic primary for governor, have criticized the lawsuit as a political maneuver.
Fulop remarked, “I think it’s a political sideshow, It’s a stunt.”
Meanwhile, Baraka dismissed the suit as “absurd” and vowed to contest it.
“While states and local governments are free to stand aside as the United States performs this important work, they cannot stand in the way. And where inaction crosses into obstruction, local governments break federal law,” the lawsuit reads, cited by The New York Times.
The lawsuit outlines that local governments can opt not to assist federal immigration enforcement, but they are forbidden from obstructing it.
The cities allegedly block federal agents from accessing information on individuals’ immigration status, a move that officials argue compromises national security and protects criminals from deportation.
Newark Mayor Ras Baraka, recently arrested during a clash with immigration officers, has been particularly vocal against the lawsuit.
Baraka claims, “No one is blocking them from doing anything. The courts have already said that it’s not an obligation of…you know…to execute federal laws to allow these people to do what they are doing.”
The argument hinges on the interpretation of federal responsibilities and the areas where local jurisdictions can exercise autonomy.
