Justice Neil Gorsuch’s majority opinion clarified that Section 1983 doesn’t allow private citizens to sue states over Medicaid provider choices unless a law explicitly grants that right.
This paves the way for more states to defund Planned Parenthood without facing legal challenges from individuals.
Conservative circles see this as a deserved check on judicial overreach.
“After all, the decision whether to let private plaintiffs enforce a new statutory right poses delicate questions of public policy. New rights for some mean new duties for others. And private enforcement actions, meritorious or not, can force governments to direct money away from public services and spend it instead on litigation,” Gorsuch wrote.
“The job of resolving how best to weigh those competing costs and benefits belongs to the people’s elected representatives, not unelected judges charged with applying the law as they find it,” he added.
Justice Ketanji Brown Jackson, in her dissent, raised concerns that the ruling could limit Medicaid recipients’ rights, leading to reduced access for low-income Americans, particularly in rural regions lacking healthcare alternatives.

South Carolina Governor Henry McMaster hailed the decision as a victory for states’ rights and autonomy over fiscal choices without federal overreach.
Governor McMaster and similar conservative leaders emphasize their commitment to redirecting funds from abortion providers to comprehensive health care alternatives, thereby enhancing state sovereignty.
“Seven years ago, we took a stand to protect the sanctity of life and defend South Carolina’s authority and values – and today, we are finally victorious,” McMaster said.
This ruling opens doors for other conservative states aiming to implement similar policies, potentially decreasing the availability of Medicaid-supported healthcare services and requiring alternative state funding mechanisms for comprehensively servicing low-income populations.
