The Democratic Party and President Joe Biden’s reelection effort face a significant challenge in Ohio due to a state law that might exclude Biden from the November election ballot, The Daily Wire reports.
The Office of the Ohio Secretary of State notified Liz Walters, the Ohio Democratic Chair, at the end of last week about a problematic discrepancy in the state’s legislation.
This issue arises because the Democratic National Convention, where Biden is expected to receive his official nomination, is set for August 19.
This date falls 12 days after the Ohio Secretary of State’s deadline for the certification of presidential nominees, as reported by ABC News.
Paul Disantis, legal counsel for the Ohio Secretary of State, expressed his conclusions in a letter, quoted by the Wire.
“I am left to conclude that the Democratic National Committee must either move up its nominating convention or the Ohio General Assembly must act by May 9, 2024 (90 days prior to a new law’s effective date) to create an exception to this statutory requirement,” he informed.
The letter was also shared with key Democratic leaders in the Ohio legislature, reflecting the political dynamics in a state legislature dominated by Republicans.
In response to the unfolding situation, a spokesperson for Biden’s campaign assured that the president would appear on the Ohio ballot.
“We’re monitoring the situation in Ohio and we’re confident that Joe Biden will be on the ballot in all 50 states,” the official said.
Ohio’s pivotal role as a swing state in recent elections adds to the urgency of resolving this legal quandary.
Historically, Ohio has been a crucial battleground, with its 17 electoral votes swinging from Democratic victories in 2008 and 2012 to leaning heavily Republican in the last two elections, where Donald Trump secured significant wins.
Currently, polling data from RealClearPolitics indicates that Trump holds a notable lead over Biden in Ohio, with a 10-point advantage.
This lead is underscored by Trump’s consistent double-digit lead in the latest polls from the state.
